Any purchase of product from ThemeStore implies that you have read and accepted the Terms and Conditions of use. If you do not agree with these Terms and Conditions, do not purchase any product, subscribe to any service, or use any materials provided therein.

We reserve the right to change the Terms and Conditions at any time, with no prior notice.

1. Limitation of Liability

ThemeStore will not be held responsible for any indirect, direct, incidental, special, or consequential damages including but not limited to loss of data or profit from the use of the provided materials, or inability to use the provided materials. This applies even if ThemeStore or an authorized representative was informed of the possibility thereof. ThemeStore will not be held liable for cost of repairs or service if use of the provided materials results in physical damages or need for correction.

2. License

These themes are created for use with WordPress, which is an open source software released under public license. Therefore, all parts of a theme that are a derivative work of WordPress are also licensed under the GPL 3.0. The files that compose these themes are a variety of types. All JS and PHP files are released under the GPL 3.0 unless otherwise stated in the file itself. If specified otherwise, the files are licensed or dual licensed under the MIT; a compatible GPL license.

All other files included with the themes, but limited to; cascading style sheets, Photoshop, and images, are not compiled with GPL code and are not GPL themselves. These files are provided on a personal use basis and are not licensed under the GPL. These files may not be offered in either modified or unmodified fashion for redistribution or resale of any kind.

3. Developer’s License

The CSS and image files of each theme are provided for personal use, as outlined above. The Developer’s License is available for users that wish to use the themes as part of a web design service. This license permits use of themes on any number of websites, regardless of ownership, as long as they are coupled with a top level domain and are part of a web design service.

The following restrictions apply:
   Downloadable access or instant installation may not be provided to any additional user
   The themes may not be provided as with an automated blogging service. They may not be coupled
       with any content management package or web hosting

4. Ownership and Liability

Licensing does not infer transfer of exclusive or intellectual ownership of the products, modified or not. All products remain property of ThemeStore. All products provided are done so “as is” with no availability or implication of warranty. ThemeStore accepts no liability in the event of any damages or losses incurred by use or inability to use said products.

Refund Policy

Refunds are available for unsatisfied customers up to 30 days from purchase date.

6. Warranty

Themes are provided “as is” with no warranty of any kind, expressed or implied. ThemeStore does not guarantee all themes will work in all browsers, nor functional with all versions of WordPress. ThemeStore does not guarantee compatibility with any third party alterations, plug ins, or scripts.

7. Modifications

The user is authorized to make necessary modifications to the product to fit their needs. The modified theme may not be redistributed or re-released. All PHP and Javascript files are released under the GPL and may be redistributed by those terms. Credit links may be removed with the understanding that copyright is still intact. Any plug ins used must retain their license.

8. Payments

All payments are handled through 2Checkout. Subscriptions are recurring unless otherwise cancelled.

9. Photos Copyright Info

Several photographic images are used in the various demo sections of ThemeStore’s website. These photos are used for display only and are not included with membership. No theme comes packaged with any copyrighted photography. All photos are provided for demo purposes for visitors to see a functional preview of a theme. It is the responsibility of the user to provide thumbnail images. The photos used in our demos are licensed from http://www.bigstockphotos.com/, and are Copyright BigStock.
